    1. Acceptance of Terms

    By accessing or using GTM Heroes ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

    2. Description of Service

    GTM Heroes provides behavioral intelligence tools for sales teams, including prospect profiling, sales blueprint generation, and related features powered by our HBX engine.

    3. Account Responsibilities

    You are responsible for maintaining the security of your account and all activities that occur under it. You must provide accurate information and promptly update any changes.

    4. Acceptable Use

    You agree not to use the Service to violate any laws, infringe on intellectual property rights, transmit harmful code, or engage in any activity that disrupts the Service or its users.

    5. Payment Terms

    Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days' notice.

    6. Intellectual Property

    The Service and its original content, features, and functionality are owned by GTM Heroes, Inc. and are protected by copyright, trademark, and other laws.

    7. AI Features

    The Service uses artificial intelligence to generate behavioral profiles, recommendations, and related insights. Outputs are probabilistic and assistive. They are not guarantees of any sales or business outcome, and you remain responsible for how you use them. Data you submit through the Service is not used to train our AI models or our AI providers' models, as described in our Privacy Policy.

    8. Warranty Disclaimer

    The Service is provided "AS IS" and "AS AVAILABLE." To the maximum extent permitted by law, GTM Heroes disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of AI-generated outputs. GTM Heroes does not warrant that the Service will be uninterrupted or error-free.

    9. Limitation of Liability

    To the maximum extent permitted by law: (a) GTM Heroes is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data; and (b) GTM Heroes' total aggregate liability arising out of or relating to the Service is capped at the amount you paid GTM Heroes in the twelve (12) months before the event giving rise to the claim, or one hundred dollars ($100) if you have paid nothing. If you have a separately signed agreement with GTM Heroes, that agreement's terms control for the services it covers.

    10. Termination

    You may stop using the Service and cancel your account at any time. GTM Heroes may suspend or terminate accounts that violate these terms, after notice where practicable. On termination, your data is deleted or returned as described in our Privacy Policy.

    11. Governing Law and Disputes

    These terms are governed by the laws of the State of Delaware, without regard to conflict of laws rules. Before filing any claim, you and GTM Heroes will try in good faith to resolve the dispute informally for thirty (30) days after written notice. Any dispute not resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Wilmington, Delaware, and judgment on the award may be entered in any court of competent jurisdiction. Disputes will be resolved on an individual basis only; class and representative actions are waived. Either party may seek injunctive relief in Delaware courts for intellectual property or confidentiality claims.

    12. Force Majeure

    Neither party is liable for delay or failure to perform (other than payment obligations) caused by events beyond its reasonable control, provided the affected party uses reasonable efforts to mitigate.

    13. General

    If any provision of these terms is unenforceable, the rest remains in effect. Failure to enforce a provision is not a waiver. These terms, together with our Privacy Policy, are the entire agreement between you and GTM Heroes regarding the Service unless you have a separately signed agreement with us. We may update these terms; material changes will be notified via the Service or email, and continued use after the effective date constitutes acceptance.
